State of Florida County of Jefferson This indenture made and entered into on this, the thirtieth day of March A.D. 1867, between Bt. Capt. A. B. Grumwell, agent B.R.F. & A.L, Monticello, Fla., party of the first part, and William S. Dilworth, party of the second part, of the aforesaid County and State witnesseth; - Whereas there are two orphan children named Lewis Binyard, aged fifteen years, and Martha Binyard, aged thirteen years, now living and employed as plantation laborers upon the plantation of the said W. S. Dilworth, and the said minor children, having been deserted and abandoned by one Oliver Binyard, a freedman, who claimed and exercised a control over them without any lawful authority, and the said minor children, having appeared before the said party of the first, and asked for and consented to the appointment of the said party of the second part as their guardian, and it being the duty of the said party of the first part, by virtue of his office aforesaid, under the laws of the United States, to make all suitable arrangements in regard to finding out and apprenticing orphans and neglected children of freedmen and appointing suitable guardians over them when, in his opinion, it shall be

necessary and proper, This indenture therefore witnesseth that in consideration of the covenants and undertakings of the said party of the second part hereinafter mentioned, with the consent of the aforenamed minor children, Lewis Binyard and Martha Binyard, the said party of the first part doth hereby place, bind, and indent the said minors to the said party of the second part to dwell and serve after the manner of apprentices, under the authority and control of the said party of the second part, the said Lewis Binyard, until he shall arrive at the age of twenty-one years, to wit on the first day of January A.D. 1873, and the said Martha Binyard, until the first day of January A.D. 1872, when she shall have attained the age of eighteen years. And, the said party of the second part for himself, his heirs, executors and administrators, doth hereby covenant with the said party of the first part that he will, during the term aforesaid or as long as the said minor shall remain with and faithfully serve him, constantly supply them with good, suitable and sufficient food, lodging, and clothing, and all other things necessary in sickness and health, that he will cause them to be instructed in reading and

writing and train them up in the habits of industry and temperance, and that he will pay the said Lewis Binyard one hundred dollars and give him a good horse or mule when he shall become of lawful age as aforesaid and that he will pay the said Martha Binyard one hundred dollars when she shall attain the age of eighteen years as aforesaid. And, it is further agreed between the contracting parties hereto that the contract for the current year shall be carried out the same as if this indenture had never been executed, but the guardianship and control under this indenture shall take effect from the date hereof.
